Terms & Conditions – The Art of Writing, LLC (the Firm and/or Us) as of 3/20/2025 update
You: You means the individual accessing or using the Firm, service, or company, or other legal entity.
Eligibility: You may participate in the services of the Firm and accept these Terms, if you are at least 18 years old or over the age of majority in the country where you reside and are competent in the English language. If You disagree with any part of these Terms of Service then You may not access the Service.
Condition: As a condition of use, you promise not to use The Art of Writing, LLC, (the Firm) or the website artwilliams3.com for any purpose that is unlawful or prohibited by these Terms, the laws of your state or country, or for any other purpose not intended by the Firm. The Firm is here to serve, help, entertain, inspire, and/or train writers and members who want to grow their writing skills and attempt to attain publication for their works, but the Firm does not guarantee acceptance by any media, publication, or digital entity.
Tolerance: This is a welcoming site for a wide variety of writers and members and will not accept communications of intolerance, or political or religious doctrines, that abuse, harass, threaten, impersonate, or intimidate any person.
Content/Decency Rules: Most topics/genres are acceptable. However, avoid scenes of animal cruelty, excessive profanity/violence, pornography, racism, graphic or gratuitous sex, or other content that is not appropriate for a mainstream literary audience.
User Accounts: When You create an account with Us, You must provide Us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service. You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party.
Submissions and Postings: You agree to not: post, transmit, or otherwise communicate content that is libelous, defamatory, pornographic, abusive, or that infringes any copyright or other right of any person, or to communicate with The Art of Writing, LLC, (the Firm) in an abusive or offensive manner; to not post or transmit, or cause to be transmitted communications intended to obtain password, account or private information from any member or author or the Firm; to create or transmit ‘spam’ to any person or entity; to post copyrighted content that does not belong to you unless you are commenting on visual content in blogs, subject to providing attribution to the copyright owner and a link to the source of the content.
Suspension and Termination of Services, by you: You can terminate your subscription/membership and delete your account at any time through your account management page. Such termination and deletion will result in the deactivation or disablement of your account and access to it, and the deletion of content you collected through use of the services. Terminations are confirmed quickly, and you will no longer be charged again for the services, unless you purchase a new one at the current rate which may be higher. If you terminate in the middle of a billing cycle, you will not receive a refund unless you are terminating these terms for any of the following reasons: (1) we have materially breached these terms and failed to cure that breach within 30 days after you have so notified us in writing; (2) a refund is required by law; or (3) we, in our sole discretion, determine a refund is appropriate. For clarity, we will not grant a refund where you have used our services, collected responses, and/or downloaded your responses, unless the termination is due to our material, uncured breach or a refund is required by law.
Suspension and Termination of Services, by the Firm: For Cause. Also, the Firm may suspend performance or terminate your subscription/membership for any of the following reasons: (1) you have materially breached these terms and failed to cure that breach within 10 days after the Firm has so notified you; (2) you cease your business operations; (3) you fail to pay fees for 10 days past due date. Additionally, the Firm may limit, suspend, or terminate the service to you: (a) if you fail to comply with these terms, (b) if you use the services in a way that causes legal liability to us or disrupts others’ use of the services; or (c) if we are investigating suspected misconduct by you. Also, if we limit, suspend, or terminate the services you receive, depending upon the reason, we will endeavor to give you advance notice and an opportunity to obtain a copy of your content from that service. However, there may be time sensitive situations where the Firm may decide that we need to take immediate action without notice. The Firm has no obligation to retain your content upon termination of the service.
Feedback: Constructive Feedback via email is welcome and means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service.
RSVP: If a meeting is planned, please RSVP that you plan to attend an upcoming digital or in-person meeting in order to save your place.
Please provide your email address, so that our coordinators can supply You with any other communications, as well as an online Zoom, Google Meet, or other link confirming the date and time of the next event(s).
Critiques: After you decide to join the group as an active member, when instructed, You may send one submission by email for critique, limited to no more than 1,000 words, embedded within Your email. Attachments will not be accepted, due to security concerns. Only the first 1,000 words will be reviewed for critique.
Format: Preferred formatting for submissions is Microsoft Word, using Times New Roman font, 12-point, double-spaced text, with paragraphs indented 0.2.
